This was heard when the accused rapist, Thembinkosi Sibanda (23), pleaded guilty before Bulawayo magistrate, Mr Victor Mpofu, where he was facing charges of having sexual intercourse with a minor (statutory rape).
It is the State's case as presented by Mrs Memory Ndlovu that on a date unknown to the prosecutor but some time in August last year, the accused person, Sibanda, fell in love with the minor. It is said one day in that same month, Sibanda visited the girl in the evening and begged to have sex with her.
The court heard that she refuse and told Sibanda that she was not ready as she was still at school. However, the accused person reportedly sweet-tongued the girl. He allegedly told the girl that she was not supposed to be worried as he would facilitate for her to abort if ever she gets pregnant. The court further heard that the teenage girl finally succumbed to Sibanda's negotiating antics and agreed to have unprotected sex with him.
Later on, the school girl fell pregnant forcing her guardian to report the case to police leading to Sibanda's arrest. The minor was later referred to hospital for medical examination and the doctor's report revealed that she was seven months pregnant and HIV positive.
When asked by the court why he had committed, Sibanda said he was not aware that the girl was 15 years old. He was remanded in custody ti 27 March for judgment.
